These Terms of Service (“Terms”) govern your access to and use of Levercast (the “Service”), operated by Switch Dimension (“Switch Dimension”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Your account
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at info@switchdimension.com if you suspect unauthorized use.
3. The Service
Levercast lets you capture content, reformat it for multiple platforms using AI, and publish or schedule it to social platforms you connect. We may modify, suspend, or discontinue features at any time.
4. API keys and MCP access
You may generate API keys to access the Service programmatically, including through our MCP server. You are responsible for keeping keys secret and for all actions taken with them. Treat each key like a password, do not commit keys to source control, and revoke any compromised key immediately under Settings → API Keys. API access is subject to rate limits.
5. Connected platforms
When you connect a third-party platform (such as LinkedIn, X, Circle, or Instagram), your use of that platform remains governed by that platform’s own terms and policies. You are solely responsible for complying with the applicable developer and platform terms, including the X Developer Agreement and Policy, the LinkedIn API Terms, the Meta Platform Terms and Developer Policies, and Circle’s terms. We are not responsible for the availability or actions of third-party platforms, and a platform may suspend or revoke access at its discretion.
6. Your content
You retain all ownership of the content you submit to the Service. You grant us a worldwide, non-exclusive license to host, store, process, reproduce, and transmit your content solely to operate and provide the Service, including reformatting it with AI and publishing it to the platforms you direct. You represent that you have the rights necessary to submit your content and to authorize its publication.
7. AI-generated output
The Service uses AI to generate suggested copy. AI output may be inaccurate, incomplete, or unsuitable. You are responsible for reviewing and approving all content before it is published. We make no warranty regarding AI-generated output.
8. Acceptable use
You agree not to use the Service to:
- Violate any law or the terms or policies of any connected platform.
- Send spam, or post deceptive, fraudulent, harassing, hateful, or otherwise abusive content.
- Publish content that infringes the intellectual property, privacy, or other rights of any person.
- Distribute malware or attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the Service, or circumvent rate limits or security controls.
- Use the Service or automation in any way that could cause a connected platform to suspend, penalize, or restrict your account.
- Reverse engineer, resell, or misuse the Service except as expressly permitted.
We may suspend or terminate accounts that violate this section.
9. Plans and fees
Some features of the Service may require a paid subscription. Pricing, billing terms, and refund policies will be presented to you at the time of purchase. [Add specific billing and refund terms here before launch.]
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends, and we may delete your content in accordance with our Privacy Policy.
11. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
12. Limitation of liability
To the maximum extent permitted by law, Switch Dimension will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amounts you paid us in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Switch Dimension from any claims, damages, liabilities, and expenses arising from your content, your use of the Service, or your violation of these Terms or any third-party platform terms.
14. Governing law
These Terms are governed by the laws of Ireland, and the courts of Ireland will have exclusive jurisdiction over any dispute, except where applicable law provides otherwise.
15. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and revise the effective date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
